Artificial Intelligence Radio - Transceiver (AIR-T)¶
The person or organization who has purchased an AIR-T, the "Product", directly from Deepwave Digital Inc is a "Customer" for purposes of coverage under this limited warranty.
Deepwave Digital Inc warrants that the Product will be free from defects in material and workmanship for a period of 12 months from the date of Deepwave Digital's shipment of the Product to the Customer. In the event of a defect covered by this limited warranty, Deepwave Digital Inc will, at its sole discretion, and free of charge to Customer, repair, replace, or refund the purchase price paid.
DEEPWAVE DIGITAL INC MAKES NO OTHER EXPRESS WARRANTIES EXCEPT AS PROVIDED HEREIN, AND ANY AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR PARTICULAR PURPOSE SHALL ONLY BE IN EFFECT DURING THE 12 MONTH WARRANTY PERIOD PROVIDED HEREUNDER. DEEPWAVE DIGITAL INC'S LIABILITY ON ANY WARRANTY CLAIM SHALL BE LIMITED TO THE ACTUAL PURCHASE PRICE PAID. DEEPWAVE DIGITAL, INC SHALL NOT BE RESPONSIBLE TO CUSTOMER OR ANY THIRD PARTY FOR ANY CONSEQUENTIAL, INCIDENTAL, OR INDIRECT DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, REVENUES, SALES, BUSINESS, GOODWILL, OR ILLEGAL USE.
Deepwave Digital Inc has no obligation to repair, replace, or provide refunds in the following instances:
- If the alleged defect arises because Customer has altered or repaired the Product without the prior written consent or authorization of Deepwave Digital Inc;
- If Customer did not follow any applicable instructions for proper storage, usage, or maintenance of the Product;
- If Customer has failed to notify Deepwave Digital Inc of any defect where the defect should have been reasonably apparent on inspection; or
- If Customer fails to notify Deepwave Digital Inc of the defect within 12 months of Deepwave Digital Inc's shipment of the Product to Customer.
The Product is sold as test equipment. If you choose to use your Product to transmit using an antenna, it is your responsibility to make sure that you are in compliance with all laws for the country, frequency, and power levels in which the device is used. Additionally, some countries regulate reception in certain frequency bands. Again, it is the responsibility of the user to maintain compliance with all local laws and regulations. Deepwave Digital is not responsible for any lawsuits, fines, or damages that violate these laws or policies.
This limited warranty does not cover the cost of the Customer shipping a defective Product to Deepwave Digital Inc for repair, replacement, or refund. Additionally, This limited warranty does not cover the cost of shipping a repaired or replacement Product back to the Customer.
